Terms of Use

Welcome to OUT!, a mobile application and service that enables users to share real-time location, communicate with friends and family, and engage in shared journeys. These Terms of Use ("Terms") govern your use of OUT! and form a legal agreement between you and OUT! ("we," "our," or "us").

By downloading, accessing, or using OUT!, you agree to comply with and be bound by these Terms, our Privacy Policy, and any registration or consent forms you complete in the course of using the app.

At this time, access to OUT! is provided free of charge. However, we reserve the right to change this at our sole discretion. You remain responsible for any mobile or data usage charges incurred during your use of the app.

 

1. License and Use

We grant you a limited, revocable, non-exclusive, non-transferable license to use OUT! for your personal, non-commercial use on a device you own or control. All rights in and to the app, its code, and associated services remain with us.

If you are under the age of 18, you may only use the app with parental or guardian consent.

 

2. Restrictions

You agree not to:

  • Modify, reverse engineer, decompile, or create derivative works of the app or its services.

  • Use the app for any unlawful, unauthorized, or commercial purposes.

  • Interfere with or disrupt the app’s functionality or servers.

  • Use the app to harass, impersonate, or harm others.

We reserve the right to suspend or terminate your account at any time for violations of these Terms.

 

3. Ownership and Intellectual Property

All content in or on the app, including but not limited to images, text, logos, sounds, software, and user interface, is owned by OUT! or its licensors. You retain ownership of content you upload, but grant OUT! a perpetual, worldwide, royalty-free license to use, display, and share that content for any purpose related to operating and promoting the service.

 

4. User Content

You are responsible for all content you post or transmit through OUT!. You represent that you have all rights necessary to share such content and that it does not infringe any third-party rights. We may remove or restrict access to content at our discretion.

 

5. Location Sharing

OUT! allows users to share their real-time location and travel mode (driving, biking, walking, etc.) with approved contacts. By using the app, you understand and agree to share your location with contacts of your choice. You can change your sharing permissions in the settings at any time.

6. Privacy and Data Use

Please see our Privacy Policy below for full details. By using OUT!, you consent to our collection and use of your personal data, including but not limited to device data, location, usage statistics, and communications metadata, for the purpose of operating and improving our services.

 

7. Termination

You may terminate your account at any time through the app or by written notice. We may also suspend or terminate your access for any violation of these Terms. Upon termination, your license to use OUT! ends immediately.

 

8. Disclaimers

The app is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation. Your use of OUT! is at your sole risk.

 

9. Limitation of Liability

To the maximum extent permitted by law, OUT! shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed $5 or the amount you paid to use the service in the past year, whichever is lower.

 

10. Governing Law

These Terms are governed by the laws of the State of Israel. Any disputes will be subject to the exclusive jurisdiction of the courts of Tel Aviv – Jaffa, Israel.
